These Terms of Service ("Terms") constitute a legally binding agreement between BORDE & KURV ("we," "us," "our") and the client ("you," "your," "Purchaser"). By placing an order, paying an invoice, or accepting delivery of our products, you agree to be bound by these Terms.

 

1. Nature of Our Product (Artistic License)

1.1 Seasonal & Handcrafted.

Charcuterie styling is an art form dependent on seasonal availability. While we strive to adhere to the style and color palette shown in our photos, we do not guarantee exact replication of specific ingredients, fruits, cheeses, or garnishes.

1.2 Substitutions.

We reserve the right to make comparable substitutions of equal or greater value based on market freshness and availability without prior notice. (For example, substituting figs for grapes depending on the season).

1.3 Perishability.

Our products are fresh and perishable. They are designed to be consumed shortly after delivery or refrigeration.

2. Ordering & Payment

2.1 Payment Terms.

* Website Orders: Full payment is required at checkout.

* Catering/Events: A non-refundable deposit (amount specified on invoice) is required to secure your date. The remaining balance is due by the date listed on your invoice.

2.2 Final Sale.

Due to the custom and perishable nature of food products, all sales are final. We do not accept returns or exchanges on food items.

3. Delivery Policy

3.1 Delivery Windows.

We provide a delivery window (e.g., 2:00 PM – 4:00 PM). Due to traffic, weather, and road conditions in the Roaring Fork Valley, we cannot guarantee an exact minute-by-minute arrival time.

3.2 Recipient Availability.

You are responsible for ensuring someone is available to receive the order.

 * The "15-Minute Rule": If no one is available to receive the delivery and we cannot access the property (locked gates/doors), our driver will wait a maximum of 15 minutes while attempting to contact you.

 * Failed Delivery: After 15 minutes, we reserve the right to leave the order at the safest available location (at your risk) or return the product to our kitchen. Returned items are not eligible for refunds. Redelivery may be attempted for an additional fee, schedule permitting.

3.3 Transfer of Risk.

Responsibility for the product (including risk of loss, theft, spoilage, or animal/pest damage) passes to you immediately upon delivery or drop-off at the designated location.

4. Food Safety & Handling

4.1 The "4-Hour Rule".

Charcuterie (meats and soft cheeses) should not sit at room temperature for longer than 4 hours.

4.2 Client Responsibility.

Once delivered, you are solely responsible for proper storage and handling.

* If not serving immediately, products must be refrigerated.

* BORDE & KURV is not liable for illness or spoilage resulting from products left unrefrigerated, placed in direct sunlight, or mishandled after delivery.

5. Allergens & Dietary Restrictions

5.1 Cross-Contamination Warning.

We are NOT a nut-free, gluten-free, or dairy-free facility. Our kitchen handles milk, eggs, wheat, peanuts, tree nuts, soy, sesame, fish, and shellfish. While we can omit specific ingredients upon request, we cannot guarantee that any product is completely free of allergens due to shared equipment and handling.

5.2 Liability.

You agree to notify your guests of this risk. BORDE & KURV assumes no liability for adverse reactions to foods consumed.

6. Equipment Rentals (Boards, Risers, Bowls)

6.1 Rental Items.

Unless you have purchased a disposable board option, all wooden boards, platters, risers, bowls, and spreading utensils are rentals and remain the property of BORDE & KURV.

6.2 Care Instructions.

* DO NOT put wooden boards in the dishwasher.

* Please wipe boards clean of food debris with a damp cloth before returning.

6.3 Return Policy.

Rentals must be returned or made available for pickup within 48 hours (or the agreed-upon date) following your event.

6.4 Damaged or Missing Items.

You authorize us to charge the credit card on file for any unreturned or damaged items:

* Late Fee: $25 per day.

* Lost/Non-Returned Board: $150 - $300 per item (depending on size).

* Damaged/Warped Board: Full replacement cost (due to dishwasher usage or breakage).

7. Cancellations & Refunds

7.1 Standard Orders.

Cancellations must be made at least 48 hours prior to the scheduled delivery for a full refund. Cancellations made within 48 hours are non-refundable as ingredients have already been sourced.

7.2 Event/Grazing Table Orders.

* 60+ Days Prior: Full refund less non-refundable deposit.

* 30–60 Days Prior: 50% of the total invoice is due.

* Less than 30 Days Prior: 100% of the total invoice is due.

8. Quality Claim

If you are dissatisfied with the quality of your order (e.g., damage during transit, missing items), you must:

* Contact us immediately (within 2 hours of delivery).

* Provide photos of the issue.

Claims made after the product has been substantially consumed or the day after delivery will not be honored.

9. Limitation of Liability

To the fullest extent permitted by Colorado law, BORDE & KURV shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total liability is limited to the purchase price of the specific order.
